Welcome to our website, operated by Magnet Developments SA (“Company”, “Controller” or “we”). The purpose of this policy is to inform you about the processing of your data when you use www.amberforest.ro (hereinafter referred to as the “Website”). The legal basis for this processing is Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data and repealing Directive 95/46/CE (GDPR) and Law no. 506/2004 regarding the processing of personal data and the protection of privacy in the electronic communications sector.
As a Data Controller we collect and process a series of personal data from you as a user of the Website, the protection of such data being very important to us.
This privacy policy (hereinafter referred to as the “Policy”) describes our practices regarding the collection of your personal data as a result of interaction with the Website.
- Categories of personal data processed
1. Traffic data generated by the use of the Website:
1.1. The Website automatically collects certain information that is stored in the form of logs. This information includes the IP address, the general location of the device used to access the Website, the type of browser used to access the Website, the operating system of the device, the date and time of access, the link of the page accessed, the history of viewing of the Website pages.
1.2. This information reaches the server on which the Website is hosted following your request to access its content, and part of the information collected is used to ensure the maintenance of the Website, to contribute, as applicable, to the diagnosis of certain related problems of Website or server and to ensure its security.
1.3. The legal basis of the processing is the compliance with the Terms and Conditions of Use, our legitimate interest to monitor the activity of the Website and ensure its security. In addition, the legal basis for the processing is also represented by the legitimate interest of the Controller to defend its rights and to respond to possible complaints and/or requests from the data subjects.
- When using the meeting scheduling form:
2.1. Through the meeting scheduling form, a form available on several pages of the Website, the following information is collected: first and last name, e-mail, telephone number, allocated budget, desired housing type, number of bedrooms (number of rooms), type of financing, desired method of meeting and/or other personal data that may derive from the message sent through the contact form.
2.2. This information is used to be able to get in touch with you and present you with a personalized offer according to your requirements or to schedule a viewing for the type of desired home.
2.3. The legal basis of the processing is the fulfilment of the necessary steps, at the request of the data subject, before the conclusion of a contract and the legitimate interest of the Controller.
- When you use the Website newsletter:
3.1. Through the Website newsletter subscription form, we collect the e-mail address provided.
3.2. The e-mail address provided is used to be able to send you information about the offer of housing types, about the Company’s present and future projects.
3.3. The legal basis for processing is the consent you give us through the section specific to subscribing to the newsletter. You can withdraw your consent at any time through the link available in the content of the message we send you or by sending an e-mail to the address office@alesonor.com.
3.4. To send you the Company’s newsletters, we use MailChimp, a service that offers certain online tools that can be used to create, send and manage emails. The list of e-mail addresses, in order to send newsletters, is also collected by MailChimp.
3.5. In addition, through MailChimp, we will be able to measure the performance of certain newsletter campaigns, improve certain customer segments and compile certain reports regarding the type, content and number of e-mails sent.
3.6. Considering that MailChimp is a company in the United States of America, the processing carried out by them, according to their privacy policy, is based on the standard contractual clauses of the European Commission.
3.7. The period of data processing, respectively of the e-mail address, is directly proportional to the period of time for which you have given us your consent. For clarity, your e-mail address will be processed for the purpose of sending newsletters by the Company until you withdraw your consent.
- Google Analytics
4.1. When accessing the Website, through the cookies set by Google Analytics and based on the consent granted through the cookie management panel, a series of information is collected regarding the number of active users, data about the device used to access it (model and the operating system), the number of active sessions, the duration of the sessions, the date and time of their creation and the geographical area in which the device used to access the Website is located.
4.2. This information is processed to help us understand how users use the Website, how they got there and which segments they belong to.
4.3. The legal basis of this processing is represented by the consent you give us through the cookie management panel, panel available when you first access the Website and to which you can return at any time by accessing the specific link in the footnote of the Website.
4.4. For the purposes of the above processing, the data is transferred via Google Analytics to Google. According to the selection from the administration account and according to Google’s privacy policy, for entities from the European Union, the data will be processed only in the European Economic Area and in case that the storage and/or processing will involve the transfer of data outside the European Economic Area, Google will make sure that Google LLC will comply with legal frameworks that ensure a level of protection equivalent to European Union legislation and the transfer of data will be carried out on the basis of an agreement, in accordance with the standard contractual clauses adopted by the European Commission.
- Google AdSense
5.1. When you use the Website, in the event that you have given us your consent through the cookie management panel, Google will set a cookie to help serve the advertisements it displays on the websites of its partners, for example, on websites that display Google ads or that participate in Google-certified ad networks.
5.2. In the event that you visit this Website and have consented to the placement of this cookie, it will be used to show you advertising with the Company’s offers on Google partner websites.
5.3. The legal basis of this processing is represented by the consent you give us through the cookies management panel that is available when you first access the Website and to which you can return at any time by accessing the specific link in the footnote of the Website.

6.1. We use Google technology – Google Hooks to allow you to view certain advertisements, through other platforms and/or websites, and interact with them, to have the opportunity to send a message directly to the Company, a message regarding the projects presented in the announcement.
6.2. A series of information is collected which, as the case may be, may refer to first name, last name, e-mail address, telephone number, allocated budget and other information arising from the message sent.
6.3. We collect this information in order to be able to contact you and present you with a personalized offer according to your requirements or to schedule a viewing for the type of home you want. In addition, this information is also collected to be able to identify potential customers for the properties developed by the Company.
6.4. The data collected through Google Hooks is processed based on our legitimate interest, as well as based on your intention to conclude a purchase contract / for the purpose of initiating pre-contact negotiations.
6.5. For the collections made in this way, the data will be processed until the purpose is fulfilled. In the event that you do not conclude a business relationship with the Controller, if you give us your consent, we will process this data to send you information about our future projects.
- Facebook Pixel
7.1. We use Meta technology to collect a series of data about the users of the Website. Your personal data refers to certain actions you perform when you visit the Website, respectively to your interests about certain types of real estate in the available offer, the searches performed, the category of the page or offers, the actions associated with certain offers.
The data collected by Meta through the Facebook Pixel is used by Meta to provide us with audience measurement services, including demographic segmentation on the basis of which the Company can customize the advertising it will display to Facebook users through Meta’s advertising services.
7.2. This data is processed through the Facebook Pixel in order to generate a statistic regarding your interaction with the Website and whether this interaction is due to advertising messages delivered through Facebook or Instagram. In addition, the information processed through the Facebook Pixel also helps us to segment visitors according to their specific preferences.
This information helps us promote our services, improve the way we display advertising and increase the audience of the Website.
7.3. The legal basis for this processing is the consent given by you through the cookie management panel. The data processed by means of the Facebook Pixel is available at all times to Facebook, which in this case is only the supplier of the technology.
Meta is the entity with which we share this information and which is a joint controller with us. The processing of this data is related to the fact that you visit the Website and does not depend on your status as a user of the Meta services, and the processing, in the event that you give us your consent, will be carried out regardless of whether or not you are connected to one of the Meta services (e.g. Facebook or Instagram).
7.4. A very important aspect to remember is that by using this service, the Company will not learn your name or other information that can identify you directly, but Meta (Facebook or Instagram) will also know this if you are a user of its services.

8.1. When you view certain advertisements displayed through Meta (Facebook or Instagram) and interact with them or in the event that you interact with forms available on the Company’s social media pages, a series of information is collected which, as the case may be, may refer to the first and last name, e-mail, telephone number, allocated budget, desired housing type, number of bedrooms (number of rooms), type of financing, desired method of meeting and/or other personal data that may derive from send the message through the contact form.
8.2. We collect this information in order to be able to contact you and present you with a personalized offer according to your requirements or to schedule a viewing for the type of home you want. In addition, this information is also collected to be able to identify potential customers for the properties developed by the Company.
8.3. The data collected through Facebook Leads is processed based on our legitimate interest, as well as based on your intention to conclude a purchase contract / for the purpose of initiating pre-contact negotiations.
8.4. For the collections made in this way, the data will be processed until the purpose is fulfilled. In the event that you do not conclude a business relationship with the Controller, if you give us your consent, we will process this data to send you information about our future projects.

9.1. Your personal data may be disclosed, as appropriate, to the following entities:
- Company specializing in providing webmail and webhosting services;
- Company specializing in providing maintenance services;
- Company specializing in providing courier services;
- Public authorities and/or other state institutions.
9.2. Additionally, depending on the purpose and categories of data processed, they may also be disclosed to:
- Google – for data processed through Google Analytics;
- Meta – for data processed through Facebook Pixel and Facebook Leads;
- MailChimp – for e-mail addresses registered in the Company’s newsletter;
- Zapier – for the data processed through Facebook Leads and Google Hooks and for their aggregation in a database;
- PipeDrive – for the data processed through the appointment scheduling forms and for their aggregation in a database.

10.1. Cookies are files placed on your device through the browser used to access the Website.
10.2. Cookies are of two types: i. own (website) cookies that are set by the website you are accessing and ii. third-party cookies set by other domains/websites than the one you are currently accessing. For example, when you access the Website, it sets its own cookie to remember the language in which to display your text (Romanian/English) and a third-party cookie from Google to create statistics about the people who access the Website.
10.3. Cookies can be used for different purposes. For example, cookies necessary to ensure the operation of the website or cookies for certain additional processing that are not related to the operation of a website – analysis cookies, used to create relevant statistics about the people who access a website.
10.4. Cookies do not retain names, dates filled in appointment scheduling forms or other similar personal data, but contain an online identifier (a unique code/ID) that helps distinguish one visitor from another, which makes for this ID to be personal data.

- the right to request the updating of the data – if they become inaccurate and/or incomplete;
- the right to request data deletion – taking into account the specifics of certain processing, for example, those carried out by means of cookies, to the extent that we will be able to identify all categories of data and if: (i) the data has been illegally processed by Company, (ii) the data are no longer necessary for the purpose for which they were collected, (iii) the period provided by law for their retention has expired, (iv) you object to the processing and there is no legitimate interest in processing them and ( v) you withdraw your consent in this regard;
- the right to request the restriction of data processing – taking into account the specifics of certain processing, for example, those carried out through cookies, to the extent that we can identify you and if: (i) you have sent us a request regarding the accuracy of the personal data processed by us (for a period that allows us to verify the correctness of the personal data), (ii) if we are processing your data unlawfully, or (iii) we no longer need your data, but you want us to keep it to ensure availability, further, in relation to any requests that you may submit to the Company.
- the right to object to the processing of personal data, including when the processing takes place in accordance with the legitimate interests of the Company;
- the right to data portability, respectively to request a copy of these, to the extent feasible, in order to transfer them to a similar controller;

- the right not to be subject to a decision based exclusively on automatic processing, including profiling, which produces legal effects concerning the data subject or similarly affects him to a significant extent;
- the right to file a complaint with the National Authority for the Supervision of Personal Data Processing (www.dataprotection.ro) or to address the courts.
11.2. The Company tries as much as possible to respond to any request within 30 days, but this period may be extended according to the provisions of Regulation (EU) 2016/679 by a further 2 months, in which case you will be notified accordingly.
11.3. There is a possibility that in certain cases you cannot be identified, and in such situations we will not be able to comply with your request.
